Pezo Privacy Notice

Pezo is committed to protecting your personal data. This privacy notice (the “Privacy Notice”) sets out what the categories of personal data Pezo may collect from you when you use Pezo’s proprietary platform (the “Platform”) and/or sign up to receive services provided by Pezo (“Services”). Personal data is information that relates to you and may identify you as an individual. We process your personal data in line with all applicable laws.

 

1.  Pezo User

 

You are a User when you use the Platform and/or sign up to receive the Services.

 

(a)  What information we collect and why

You may provide certain personal data (such as your name, email address and billing data) when you sign up for the Services or otherwise communicate or interact with us. If you become a User, we may request additional information from you via our application forms or other forms.

 

We collect and process the personal data above in order to perform our obligations under our agreement to you as a User (or prospective User), including to:

  • respond to your questions and requests;

  • provide you with access to certain functions and features of our Platform;

  • verify your identity; and/or

  • communicate with you about your account, our products, and available promotions relevant to your use of the Services.

 

(b) cookies and other similar technologies we use

We may use cookies and other similar technologies in order to collect information about your use of the Platform. As an example, to track your use of our partner affiliations and to maintain an audit trail of all those actions.

 

(c)How we may share information

We may disclose certain User information to affiliates, partners, vendors, contractors, or others who assist Pezo in delivering the Services (e.g., credit card processing). For further information, please see the “sharing your information” below.

 

(d)  Your rights

If, as a User, you wish to verify, correct, update or request the deactivation of your information, you should contact us at hello@pezo.pet. If you are receiving Pezo emails, you may “unsubscribe” using a link in the email. Please note that unsubscribing will not opt you out of notifications critical to providing the Services (e.g., email invoices). Pezo’s lawful basis for processing personal data of Users is the performance of the contract.

 

2.  Sharing your information

 

We may disclose your personal information to the following third parties:

  • Group companies supporting our services for business and operational purposes

  • Third party service providers and/or partners who provide data processing services to us or otherwise process personal information for purposes described in this Privacy Notice. These may include the categories of partners listed below:

    • Hosting providers;

    • Fraud prevention partners;

    • Card linking providers and/or

    • Trusted affiliates and partners

  • Program Partners who are third party partners (e.g. dog food supplier) who offer products and services which may qualify you to earn points, discounts, cashback and rewards (“Benefits”)

  • An actual or potential buyer (and its agents and advisers) in connection with any actual or proposed business transition, such as a merger, acquisition by another company, or sale of all or a portion of our assets, provided that your information is only used for the purposes disclosed in this Privacy Notice.

  • Any competent law enforcement body, regulatory agency, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person;

  • Anyone else with your consent.

 

 

3.  Card Linking Services

 

In certain instances, you can link your payment card (“Linked Card”) in order for card linking partners (e.g., Fidel Limited) (“Service Providers”) to identify transactions you make with Program Partners (“Qualifying Transactions”) in order to receive Benefits. In such instances, we will collect the following information:

  • Information establishing your identity (for example, name, email address, etc.);

  • Information about your location;

  • Information you provide in connection with your use or receipt of the Services;

  • Information we obtain from Service Providers related to the Services, including information about Qualifying Transactions such as merchant name and location, purchase amount, date and time, and applicable payment card network (i.e. Mastercard, Visa, American Express or any other payment card network provider from time to time). For clarity, our Service Provider will not provide us with your 16 digit Linked Card account number. Please refer to our Service Provider’s privacy policy for details about how your Linked Card account number is collected, handled and stored.

 

This information may be used from time to time for the following purposes:

  • to create your profile in the Platform and provide you with the Services;

  • to verify your identity;

  • to confirm a Qualifying Transaction and facilitate awarding and funding of Benefits;

  • to report on performance of offers associated with Benefits;

  • to promote our products and services, and promote products and services of our Partners, including providing offers that may be of interest to you;

  • to create aggregated or non-personalised data for market research and other services;

  • to help us better understand the current and future needs of our users and to help us better manage and improve the Services, our business and your relationship with us; and

  • to comply with valid requests for information about you from regulators, government agencies, public bodies or other entities who have a right to issue such requests.

 

 

4.  Rights (EEA and UK Users only) Territory Citizens

 

If you are a resident of the European Economic Area or, after the end of the UK's transitional period, the UK, you have the following additional rights:

  • right to request access to, correction of, updates to, or deletion of your personal information;

  • the right to object to processing of your personal information, ask us to restrict processing of your personal information or request portability of your information;

  • where we process your personal information on the basis of consent, the right to withdraw your consent at any time;

  • the right to complain to a data protection authority if you believe that the processing of your personal data is in violation of the legislation. For more information, please contact your local data protection authority.

 

If you are in the UK, or the European Economic Areas, the controller of your data is Pezo Technology Limited. We respond to all requests that we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. 5.  Legal Basis for Processing (EEA and UK user only)

 

  • In the EEA or UK, we must satisfy a "legal basis" for processing your information. Our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the purpose for which we use it.

  • We will normally rely on your consent to process your personal information for the purposes outlined but we may rely on our legitimate interests for certain activities, such as processing your information to ensure security, prevent fraud and debug and/or to defend our rights.

  • In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person.

 

6.  How we keep personal information secure

 

We use appropriate technical and organisational measures to protect the personal information that we collect and process about you.  The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information.

 

7.  International Data Transfers

 

Your personal information may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different to the laws of your country. Specifically, our personal data is stored in the cloud, and our Group Companies and third-party service providers and partners operate around the world.  This means that, when we collect your personal information, we may process it in any of these countries.

 

However, we have taken appropriate safeguards to require that your personal information will remain protected in accordance with this Privacy Notice. These include implementing the European Commission’s Standard Contractual Clauses for transfers of personal information between our group companies, which require all group companies to protect personal information they process from the EEA or the UK in accordance with European Union data protection law.

 

8.  Data retention

 

Pezo retains personal information based on how long the specific data is required for legal or business purposes.

 

When we no longer need personal data, we securely delete or anonymize it, or if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. Aggregated data, which cannot identify an individual and is used for purposes of reporting and analysis, is maintained for as long as commercially necessary.

 

9.  Children

 

None of our services are directed to children under 16. We do not knowingly collect personal data from anyone under 16 years of age. If we determine, upon collection, that personal data belongs to an individual under 16, we will not use or maintain his/her personal data. If we become aware that we have unknowingly collected personal data from a child under the age of 16, we will make reasonable efforts to delete such information from our records.
